JUSTICE KENNEDY delivered the opinion of the Court

We conclude that race-based action like the City’s in this case is impermissible under Title VII unless the employer can demonstrate a strong basis in evidence that, had it not taken the action, it would have been liable under the disparate-impact statute. The respondents, we further determine, cannot meet that threshold standard. As a result, the City’s action in discarding the tests was a violation of Title VII. In light of our ruling under the statutes, we need not reach the question whether respondents’ actions may have violated the Equal Protection Clause.

2009 Blacks in Government National Training Conference

Curt Odom, Director of Personnel Management announced Coast Guards participation in the August 2009 Blacks in Government National Training Conference in ALCOAST 373/09.  Coast Guard Report announced the annual conference in our post Civil Rights on Deck (Volume 1, Issue 7.1) on June 13th.  This will be the 31st Annual BIG conference and will meet in at the Baltimore Convention Center with a theme of “Meeting Today’s Objectives – New Challenges, New Government, a New BIG.”

Civil Rights on Deck Update

Coast Guard Report has updated our Civil Rights on Deck page which can be found on the top menu bar.

The Office of Civil Rights published it’s June edition of its version of Civil Rights on Deck on 29 June 2009.  You can read it here.   Coast Guard Report published four editions of our Civil Rights on Deck this month that each met the main objectives of the OCR’s published but missed intent.

Congressional Hearings on Coast Guard Civil Rights

The House Subcommittee on Coast Guard and Transportation held its second hearing of the year on Coast Guard Civil Rights and Diversity on 19 June 2009.

Popular Banquet Facility and Country Club Routinely Harassed Female Employees, Refused to Hire Blacks and Sued Victims as Retaliation, Federal Agency Charged

CHICAGO – A popular Hickory Hills, Ill., banquet facility and country club will pay up to $690,000 to settle two lawsuits, charging sex and race discrimination and retaliation, brought by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.

Federal District Judge Rebecca Pallmeyer has entered a consent decree resolving the two lawsuits against Chateau Del Mar, Inc. and Hickory Properties, Inc., known as Hickory Hills Country Club. Under the decree, the defendants are required pay $590,000, including attorneys’ fees, to a class of women who endured a sexually hostile work environment and retaliation, and, in addition, up to another $100,000 to African American applicants who were denied hire because of their race.

Coast Guard Mediators

Nearly a dozen Coast Guard employees completed the Federal Mediation course at the Equal Employment Opportunity Commission Training Institute in Washington, DC.  Employees representing diverse backgrounds from around the country attended the five day course at EEOC Headquarters.  Coast Guard is better equipped this week to meet the needs of its employees.

The Anniversary of Stonewall

As a gay kid growing up in rural Missouri – I never thought I would end up helping to organize an LGBT Pride event in the White House.   Then again, I never thought I would ever realize my dream to work in the White House.  But thanks to the historic election of Barack Obama, today I am honored to be working here.
